Mr Burke (Leader of the House) declared that, unless otherwise ordered, the Home Affairs Legislation Amendment (2025 Measures No. 1) Bill 2025 stands referred to the Federation Chamber for further consideration at the adjournment of the debate on the motion for the second reading of the bill.

Home Affairs Legislation Amendment (2025 Measures No. 1) Bill 2025

The order of the day having been read for the resumption of the debate on the question—That the bill be now read a second time—

Debate resumed.

Ms Steggall moved, as an amendment—That all words after “That” be omitted with a view to substituting the following words:

“whilst not declining to give the bill a second reading, the House:

(1) acknowledges that the Government is looking to find a solution to ensure that people in the NZYQ cohort, who were seeking refugee status and broke Australian laws, are not able to stay in Australia; and

(2) notes that:

(a) procedural fairness and natural justice are cornerstones of our justice system;

(b) this legislation has immense overreach by curtailing the Court’s ability to apply these where a decision to remove a person to a third party has been made; and

(c) the ramifications of this legislation will be ongoing, with real-life application for all people on bridging visa E, including those on fast-track and transitory visas”.

Amendment negatived.

Question—That the bill be now read a second time—put and passed—bill read a second time.

Leave granted for third reading to be moved immediately.

On the motion of Dr Charlton (Assistant Minister for Science, Technology and the Digital Economy), the bill was read a third time.

Treasury Laws Amendment (Payments System Modernisation) Bill 2025

The order of the day having been read for the resumption of the debate on the question—That the bill be now read a second time—

Debate resumed by Mr Conaghan who moved, as an amendment—That all words after “That” be omitted with a view to substituting the following words:

“whilst not declining to give the bill a second reading, the House:

(1) notes:

(a) that the bill implements recommendations of the 2021 Payments System Review, first initiated by the Coalition, to modernise the Payment Systems (Regulation) Act 1998 ;

(b) that, under the bill, key decisions of the Reserve Bank of Australia and the Treasurer, including designating payment systems, imposing access regimes, and setting standards, will not be subject to parliamentary disallowance; and

(c) concerns that the Reserve Bank’s narrow mandate does not allow for appropriate consideration of impacts on competition and innovation, and may not be suited to regulating fast-changing industries like fintech and digital payments; and

(2) calls on the Government to ensure that major regulatory decisions made by the Reserve Bank and the Treasurer under the Payment Systems (Regulation) Act 1998 are subject to disallowance to provide an appropriate parliamentary oversight mechanism”.

It being 1.30 pm, the debate was interrupted in accordance with standing order 43 and the resumption of the debate made an order of the day for a later hour this day.
